1. SCOPE OF APPLICATION AND VENDOR INFORMATION

1.1. Contractual Parties

These General Terms and Conditions govern the legal relationship between Art-Paint Shop KlG, conducting business as Artherium, with Registered Office: Wehriwald 8, 6436 Muotathal, Switzerland, Website: https://avarcasmenorquinas.ch, Managing Partners: Calin Popa and Elena Andronescu (hereinafter referred to as the "Vendor"), and the customer (hereinafter referred to as the "Customer").

1.2. Consumer and Entrepreneur Definitions

The Vendor provides services to both individual consumers and commercial entities. The following definitions apply under Swiss law:

• Consumer: Any natural person who enters into a legal transaction for personal consumption or purposes that are predominantly neither commercial nor attributable to their independent professional activity.
• Entrepreneur: A natural or legal person or a commercial entity with legal personality who, when entering into a legal transaction, acts in the exercise of their commercial, industrial, or independent professional activity.

1.3. Exclusivity and Priority of Terms

These General Terms and Conditions shall apply exclusively. Any terms and conditions provided by the Customer that deviate from, contradict, or supplement these General Terms and Conditions shall not be recognized unless the Vendor expressly consents to their validity in writing.

1.4. User Accounts and Registration

Registration within the online store is generally optional; however, certain features may require the creation of a user account. The Customer is responsible for maintaining the confidentiality of their credentials, and the Vendor reserves the right to suspend accounts in the event of misuse.

2. OFFERS AND SERVICE DESCRIPTIONS

2.1. Nature of the Online Presentation

The presentation of products within the online shop does not constitute a legally binding offer but a non-binding invitation for the Customer to submit a purchase order (invitation to offer).

2.2. Availability and Visual Representation

Offers are valid while stocks last. Product images and color charts are for indicative purposes; actual appearance may vary due to device settings or monitor calibrations, which does not constitute a product defect if reasonable.

3. ORDER PROCESS AND CONCLUSION OF CONTRACT

A binding purchase contract is finalized when the Vendor issues a formal Order Confirmation or invoice via electronic mail or dispatches the products. If prepayment is selected, the contract concludes upon the provision of bank account details to the Customer.

4. PRICES AND DELIVERY COSTS

All prices listed in the online store are in Swiss Francs (CHF). For deliveries within Switzerland, prices include statutory Swiss Value Added Tax. Shipping costs are calculated specifically for your order and displayed during checkout. For international deliveries outside Switzerland (including the European Union), prices are shown exclusive of Swiss Value Added Tax, and the Customer is solely responsible for any applicable local customs duties, import taxes, and processing fees upon delivery.

5. DELIVERY AND TRANSFER OF RISK

Standard delivery is typically 5 to 7 working days from order dispatch. For heavy or oversized items, curbside delivery applies. For private consumers, the risk of accidental loss or damage passes upon physical receipt of the goods. For commercial entities, the risk of loss passes upon handover of the shipment to the postal carrier or transport company.

6. RIGHT OF CANCELLATION AND RETURNS (SWISS LAW & VOLUNTARY POLICY)

Under Swiss law (Swiss Code of Obligations), there is no statutory general right of revocation for online purchases. However, the Vendor grants a voluntary 14-day return policy for unused, unopened, and resalable items.

Conditions for Return:

• The item must be in its original, sealed, and undamaged packaging.
• Notice of intent to return must be submitted to the Vendor via electronic mail at contact@avarcasmenorquinas.ch within 14 calendar days of receiving the package.
• The Customer is responsible for all return shipping costs, return logistics, and any customs declaration requirements for packages sent from outside Switzerland.

Exclusions: Voluntary returns are strictly excluded for custom-mixed colors, personalized goods, or unsealed chemical products for health, safety, and hygiene reasons.

7. STATUTORY WARRANTY AND LIABILITY

Statutory warranty rights under the Swiss Code of Obligations apply. The Customer must inspect the delivered goods upon receipt and notify customer service of any obvious defects or errors within two (2) working days. The Vendor’s liability for minor negligence is excluded to the maximum extent permitted by Swiss law. Liability remains unaffected for intent, gross negligence, or injury to life, body, or health.

8. RETENTION OF TITLE

The Vendor retains full legal title to all delivered goods until the purchase price and all associated shipping costs have been settled in full.

9. PROMOTIONAL VOUCHERS

Promotional vouchers are valid only for the specified period, cannot be exchanged for cash, and cannot be applied retroactively to completed orders. Only one promotional voucher may be redeemed per person per promotion.

10. INTELLECTUAL PROPERTY

All website content, including text, graphics, logos, images, and software, is the property of the Vendor or its content suppliers. Customers are granted a limited, non-exclusive license for personal shopping use only. Any duplication, processing, or commercial distribution requires prior written consent.

11. TRANSPORT DAMAGE

We kindly request that Customers report obvious transit damage immediately to the delivery carrier upon arrival and inform our customer service. Reporting transit damage promptly helps the Vendor assert claims against transport insurance providers.

12. GOVERNING LAW AND JURISDICTION

All legal relationships between the contractual parties shall be governed exclusively by the laws of Switzerland, excluding the United Nations Convention on Contracts for the International Sale of Goods (Vienna Sales Convention). The exclusive place of jurisdiction for all disputes arising from or in connection with this contract is the registered office of the Vendor in the Canton of Schwyz, Switzerland.
